The bankruptcy plan approved by the various creditor committees of governmental entities and individual claimants, was recently thrown out by the Federal Court. As a consequence of this unexpected decision, the stakeholders went back to the table and have been able to negotiate an additional billion dollars in contributions from Purdue and the Sackler family who owns the company. The good news is that it should leave the original plan undisturbed for the individual claimants and the Proof of Claim process that went with it. There was some concern that a new proposal would again potentially result in excluding the individual claimant payment plan, which is what the governmental entities position was throughout the bankruptcy process. In other words the Federal and State governments pursuing Purdue Pharma did not want any of the settlement proceeds to go to individual claimants.
