Travis Scott has resumed his concert schedule while the families of those who lost their lives, those people who suffered severed injuries, and all of the victims’ friends and family continue to deal with the painful memories of that day and search for answers to the question of why this happened to them. There were hundreds of concertgoers who not only were trampled but saw the unimaginable sight of people dying under the crowd, screaming for help and just trying to breathe. Ten people died that day. Hundreds sustained broken bones and suffered and continue to suffer from those memories, reliving them over and over again. Their lives have literally been permanently disrupted and changed, and they have not been able to resume their normal activities like Travis Scott.
In the litigation where BCA is in a leadership role, Jacques Bermon Webster II a/k/a “Travis Scott” a/k/a Cactus Jack and Live Nation is not the only entities and individuals we will hold responsible. Here is a list of the main corporate defendants:
With respect to the safety, wellbeing, and security of attendees and those present at the Astroworld Festival proper prior planning is required. Failure to properly plan creates unnecessary risks and hazards for those that attended Astroworld Festival and/or were otherwise present.
These entities and individuals all had and assumed the duty and responsibility for ensuring safe concert operations and made representations to concertgoers that “safety and security are always our top priority” and that they would “ensure a safe, secure, and positive environment is provided for all attendees, artists, and staff.” Tragically, due to their motivation for profit at the expense of concertgoers’ health and safety, and due to their encouragement of violence, multiple people lost their lives and scores of others were injured at what was supposed to be a night of fun. They egregiously failed in their duty to protect the health, safety, and lives of those in attendance at the concert, including but not limited to the failure to provide adequate security personnel to implement crowd control measures and the failure to provide a sufficient amount of emergency medical support. They had actual knowledge that a crowd surge would occur during the concert and Defendants knew that crowd surges are extremely dangerous events that can occur at large concerts when too many people are packed together into too small of a space. They knew that when such a crowd makes a sudden movement toward the stage, the people in front can be shoved, trampled, rendered unable to breathe, or crushed to death. Fueling this knowledge of the dangerous and deadly conditions of the concert was the online streaming of the concert. Early reports from the investigation of the Astroworld catastrophe indicate that the premises were arranged in a fashion that best served the online streaming of the concert at the detriment to concertgoer safety. They had cameras, camera stands, camera operators, and metal barriers surrounding each; these cameras effectively split the premises both horizontally and vertically by the metal barricades. The placement of cameras streaming for broadcast effectively limited many concertgoers’ means of exit; this dangerous condition would inevitably prevent individuals from dispersing.
This is a very important case not only for those who were involved in this tragedy but for the safety and security of all future concertgoers. The behavior of these corporate entities and individuals has to be changed to ensure that this does not happen again. While we work to change that behavior, Travis Scott is performing doing the same thing with his crowds. Live Nation, which had 23 prior deaths across the world at its promoted concerts continues to promote concerts with little if any changes in its protocol and procedures for the safety of its patrons. The Astroworld tragedy and the continued, unchanged business practices exemplifies these defendants’ willful, reckless, and intentional failures to plan, design, manage, operate, staff, and supervise their events. This is nothing less than a conscious disregard for the safety and welfare of those at the events.
We continue to work on the general liability phase of the litigation and depositions of these responsible corporate entities and individuals will start next month.

Astroworld Festival - Q3 2022 Update
This is still a relatively new mass tort docket arising out of the tragic ending to the Travis Scott concert at the Astroworld venue in Houston late last year, in which almost a dozen concert goers were crushed to death in a crowd surge, and thousands more sustained physical and/or life altering mental trauma.
Our law firm has been selected to serve on an executive committee with several other well established law firms to undertake the lead roles in this litigation, and we have filed almost 2000 claims for clients from around the country. This is about half of all cases filed in this litigation. As mentioned before, we were able to conduct inspections of the facility and obtain numerous concert documents in the days and weeks after the incident and we were able to get the Houston court system to consolidate all of the thousands of cases to one judge for uniform case development. While that was delayed by dilatory actions of some of the other parties who filed a formal stay on the litigation with the Texas Supreme Court, we have since been able to get the case back to the trial court and have had a number of hearings already which have produced a case management order, an agreed upon electronic data system for documents, and remission of the first rounds of formal discovery requests to all parties.
Our leading liability expert on crowd control issues, Dr. Keith Still, was also later hired by the Governor of Texas to participate in an investigation into this tragedy and make recommendations back to the governor’s office. We also have ongoing discovery into restraining orders and document preservation orders against the defendants, as we continue to share in the effort to help the other plaintiff law firms organize our own discovery teams as part of the consolidation of cases.
Our firm founder, Brent Coon, operates a national production company and knows how these events are supposed to be planned and why this one failed so needlessly. The movie producer we were working with early on has finished his work and released a documentary on the tragedy, which helps shed some public light on how this happened and is well worth the watch. STATEMENT FROM BRENT COON, ATTORNEY AND CONCERT PROMOTER
Most of you have already heard about the tragedy of the Scott/Drake concert on November 5th at the Astrohall in Houston. There was very poor crowd control at an SRO event which invited a rush to the stage and ensuing bedlam. Eight attendees were crushed to death on the scene and dozens of others taken by ambulance for a variety of injuries. Many others were left untreated and/or traumatized. In this case, the incidence of crowd rush was VERY foreseeable and is something concert promoters are supposed to take into account in contingency planning. Gates, fences, adequate security and other crowd control platforms, etc. Knowledge and consideration of attendee demographics. Seating arrangements, traffic flow, forewarnings to artists and agents, pre-concert action items and meetings. Involvement with local medical and law enforcement personal as well as detailed security briefings. Communication systems at field, gate, stage and backstage levels.
How do I know all this? Because I AM a concert producer and promoter. My company, Coondog Productions, has been promoting shows of this nature for over 2 decades at venues across the country. In addition, I am a professional performer in a band that has opened for dozens of gold and platinum artists over the years. There were major planning failures at this event, and major execution failures. The results were catastrophic. Live Nation was the primary producer on this show. They have done many thousands of major events across the county and should have been much better prepared for these types of issues, particularly in light of the nature of the venue, size of the crowd, demographics of the crowd, and the historical patterns of behavior surrounding their lead artist, Travis Scott, who has a history of trying to work the crowd into a frenzy.
We are undertaking a lead role in the litigation and have filed our first lawsuits and requests for a TRO and an MDL assignment. I am not aware of a better case to be involved in right now. We have a great venue where we have an anchor office, there were 50,000 in attendance, and we have a very horrible list of failures clearly constituting negligence on the major parties associated to this event.
The issue of crowd compression and "stage rush" has been well known in the industry for decades. It was primarily for that reason and the risks inherent to it that most venues began steering away from SRO (standing room only) events, to assigned seating. Injuries and even fatalities were an all too frequent occurrence, as was noted in high profile mass fatality incidents like The Who concert at Riverfront Coliseum in Ohio in 1979, which helped change how the industry arranged for major artist events in large venues with many thousands of attendees. Same could be said of security with crowd control from lessons learned, like the Rolling Stones concert in 1969 which involved deaths in part to use of untrained security forces.
SRO events require an entirely different and higher degree of preparedness, and with the history involving Travis Scott, the invitation of a special guest like Drake, the fact that everyone was rusty in preparing for these types of events due to a 2-year shut down of such crowds and concerts due to Covid, set the stage for this type of tragedy. Everyone involved should have been aware of that and taken the additional precautions those circumstances would mandate. They clearly didn’t.
