Q4 2022 Update
The Court recently set 200 cases to be worked up for individual trials. Only about 150 of these cases will be worked up for various reasons. The process will take the rest of the year, and then some of these cases will be remanded back to Courts all over the Country for trial.
In the meantime, the makers of Taxotere have been fighting the Plaintiffs at every turn. Even though most of the cases are in a Federal Court in Louisiana, they are governed by the state laws were the Plaintiffs live or were treated. Each state has different laws, and the Defendants are attacking cases coming from various states for various reasons. The most recent large block of cases set for a dismissal hearing in July are cases were the hospital cannot provide information regarding exactly which manufacturer of Taxotere an individual Plaintiff took.

The most recent trial against Sanofi, the maker of Taxotere was a verdict for the defense. A trial against one of the drug companies who manufactured a generic version of Taxotere is set for March 14, 2022. In the meantime, the defendants continue to attack Plaintiffs claims by getting them dismissed as a matter of law. We are cautiously optimistic that future cases will result in better results, in the meantime we do not anticipate resolution of this case in 2022.
Additionally, a small number of cases have been working towards a trial in a separate state MDL in New Jersey. The Court there recently set up eight cases to be worked up for trial sometime in 2022.

Even though most of the cases are in a Federal Court in Louisiana, they are governed by the state laws were the Plaintiffs live or were treated. Each state has different laws, and the Defendants are attacking cases coming from various states for various reasons. The manufactures of Taxotere have successfully convinced the Court that they did know that Taxotere could cause long term hair loss prior to December 15, 2006, so the Court is dismissing cases were treatment occurred prior to that date. Michigan has a different standard of causation and they are working to have most cases from Michigan dismissed. We anticipate this trend to continue, but we will continue to fight for you.
We are still cautiously optimistic that the cases will still settle sometime in the future after the next round of test trials.

The first test trial was held in 2019, but the results were not positive as the jury ruled that the damages in that case were likely due to other causes. The Court postponed the next round bellwether because of COVID-19. However, the second bellwether trial is currently set for August 23, 2021 was postponed until November 8. This case is currently in trial as of the writing of this update. Additional trials are set for early 2022.
